Pursuant to the Presidential Edict N 516 of 24 September 2001 "On improving the system of national government bodies and other state agencies subordinated to the government of the Republic of Belarus", the Council of Ministers of the Republic of Belarus hereby decreesas follows.

Part 1 of paragraph 1 is effective from 30 November 2001 (pursuant to Council of Ministers Resolution N 1781 of 11.12.2001).

1. The Department of the State Labour Inspectorate shall be established within the strcture of the Ministry of Labour and Social Protection; the said Department shall be accorded legal person status, subject to a no-objections from the President of Belarus.

2. 2. The Statute of the Ministry of Labour and Social Protection of Belarus is hereby approved.

3. It shall hereby be deemed necessary to establish, within the Ministry of Labour and Social Protection of Belarus a Collegium of 17 members.

4. The Resolutions of the Council of Ministers indicated in the list attached hereto shall be invalidated.

5. Within three months of the enactment of this Resolution, the Ministry of Labour and Social Protection of Belarus shall:

bring the relevant regulatory acts into compliance with this Resolution;

complete the restructuring of the organizations subordinated to the Ministry.

1. The Ministry of Labour and Social Protection of Belarus (hereinafter, the Ministry) is a central governmental body mandated to implement public policy, to perform management functions in the fields of labour relations, labour protection, employment, social security, demographic security, and to act in a coordinating role on these matters in respect of the other republican bodies of government; the Ministry's functions shall also include organizational, technical and informational support of the National Committee on Demography under the Council of Ministers.

2. In the delivery of its mandate, the Ministry of Labour and Social Protection shall be guided by the Constitution of the Republic of Belarus, other legislative acts of the Republic of Belarus, and the present Statute; it shall act in coordination with the national government bodies, local councils of deputies, executive and administrative bodies, public and international organizations.

3. The management structure of the Ministry's central apparatus shall be comprised of chief divisions, divisions, sections, desks, and the following departments with legal person status: the Department of the State Labour Inspection (hereinafter - Department) and the Social Protection Fund under the Ministry of Labor and Social Protection (hereinafter - the Fund).

4. The organisational styructure Ministry of Labour and Social Security shall include structural units of the regional and Minsk city executive committees, exercising public authority in the fields of labour, employment and social security, regional offices Department of the Labour Inspectorate and the Social Protection Fund (subject to the list contained in the Annex to this Statute), and the state organizations subordinated to the Ministry of Labour and Social Security, as specified in the list the list of the said organisations approved by the Council of Ministers.

5. The main functions of the Ministry of Labour and Social Protection shall include:

Identifying, formulating and implementing policies in key priority and action areas with regard to of employment promotion, decent pay and working conditions, occupational safety, social insurance and pensions, demographic security, social partnership, social services and social assistance, improvement of the socio-economic conditions of families, equal rights and equal opportunities for men and women, and the social safety nets;

Recommending improvements to the regulations on labor, employment and social protection;

Monitoring and verifying compliance with the regulations on pension provision, employment, state social insurance, occupational safety, and compensation to workers employed in hazardous conditions;

implementing international cooperation activities in these areas.

6. Pursuant to its mandated functions and area of competence, the Ministry of Labour and Social Security shall:

6.1. Formulate, in conjunction with the relevant government agencies, priorities and objectives for public policy priority on labour protection, employment support, demographic security and social protection;

6.2. Prepare and submit to the Council of Ministers progress reports on labour protection, employment support, demographic security, and social protection; contribute to draft programmes and projections on socio-economic development of Belarus for the long, medium and short term perspective;

6.3. Contribute to the design of social programmes, organise and oversee implementation of such programmes;

6.4. Manage and implement monitoring activities on labour relations (including the practice of contract-based employment), employment promotion, demographic security and social protection;

6.4-1. Submit recommendations, pursuant to established procedure, on supplemental actions for preventing violations of the rights of employees working under contract;

6.5. Recommends, pursuant to the established procedure, amendments to the minimum state social standards on labour and employment, pension provision, social assistance and social services;

6.5-1. Develop and approve, pursuant to the established procedure, standards and regulations governing provision of food, clothing, footwear, bedding to organisations and residential facilities subordinated to the Ministry of Labour and Social Security;

6.6. Draft, in collaboration with the other relevant agencies of the national government, regulations governing implementation of the social standards;

6.7. Approve, pursuant to the established procedure, the norms and guidelines for the availability of supplies, personnel and technical support to organizations subordinated to the Ministry of Labour and Social Security;

6.8. contributes, pursuant to the established procedure, recommendations on improving the system of social allowances and compensations, and on amending the procedures and eligibility requirements for accessing government social assistance and social services;

6.9. Draft and submit recommendations on improving employee remuneration systems, and changing base pay levels across economic sectors and industries;

6.10. Administer salary classification and labour norming activities across industries and sectors of the economy; establish the equivalence of professions and occupations;

6.11. Draft, in coordination with the relevant bodies of the national government, recommendation on improving salary systems for public sector employees, civil servants, military servicemen, junior-level servicemen and officers of the police force, emergency response services, and financial investigations agencies;

6.11-1. Contribute to setting targets for salary levels; communicate such targets to the national government bodies, state organizations subordinated to the Government of the Republic of Belarus, regional executive committees and the Minsk City Executive Committee; oversee compliance with such targets;

6.12. Approve the staffing structure of the state organisations subordinated to the Government of the Republic of Belarus;

6.13. Draft and approve, pursuant to the established procedure, sample organisation charts of residential facilities and other organizations subordinated to the Ministry of Labour and Social Protection;

6.13-1. Set targets for salary levels in organizations subordinated to the Ministry of Labour and Social Protection, communicate these targets to such organisations, monitor compliance and perform enforcement thereof;

6.16. Oversee the conduct of workplace assessment by employers, verify the legality of the worker compensation payments based on such assessment, and monitor conformity of the working conditions with the characteristics prescribed by the design documentation;

6.16-1. approve the job descriptions of home caregivers;

6.17. Draft, in conjunction with the relevant agencies of the national government, proposals on improving tripartite contract practices, and identify priorities for the development of such practices;

6.18. Participate in the drafting of the General Tripartite Agreement between the Government of Belarus, national associations of employers and the trade unions;

6.19. Coordinate the drafting of the National Demographic Security Programme, monitor progress and oversee the implementation of such Programme, provide methodological guidance to the development of the regional demographic security programmes;

6.20. Approve the statutes of the structural units of the regional and Minsk city executive committees mandated to perform state administrative functions in the fields of labour, employment and social protection;

6.22. Evaluate the status and utilisation of the human capital, monitor and project the trends in employment and the labour market;

6.23. Draft recommendations on improving labour mobility, project directions of geographic labour mobility in the Republic of Belarus;

6.24. Organise and coordinate the drafting and implementation of the state and regional programs on employment promotion;

6.25. Recommend changes to the unemployment registration procedure;

6.26. Coordinate public works projects;

6.27. Provide vocational training, skills upgrading and retraining programmes for the unemployed;

6.28. Promote entrepreneurship and self-employment among the unemployed and job seekers;

6.29. Contribute to the drafting of regulations and manuals on employee attestation, retraining and skills upgrading;he

6.30. Participate, in conjunction with the relevant agencies of the national government, drafting policies on vocational guidance, vocational education and continuing professional training of industrial workforce, contribute to the development of the legal framework for such training;

6.31. Organise and coordinate the management of the state social insurance funds;

6.32. Draft and submit, pursuant to the established procedure, proposals on the amount of compulsory social insurance contributions;

6.33. Organise and coordinate the maintenance of personalised savings records within the state social insurance system;

6.34. Monitor performance of the state social insurance and pension support systems, oversee implementation of the relevant regulations, recommend improvements to these systems;

6.35. Oversee the calculation and disbursement of pensions, allowances and other social transfers;

6.36. Prepare and draft decisions of the Commission for the Award of Special Merit-based Pensions under Council of Ministers of the Republic of Belarus;

6.37. Define the procedure for documenting the calculation and disbursement of pensions and benefits, approve the standard forms of such documentation;

6.38. Draft recommendations on gender policy, assist in putting in place and implementing the mechanism for ensuring equal rights and opportunities for men and women;

6.39. Contribute to drafting and implementing family and child protection policies;

6.40. Contribute to prosthetic and orthopedic care provision; maintain access to rehabilitation equipment for those in need;

6.41. Participate in the development and implementation of measures to strengthen social protection of the senior citizens, veterans, war victims;

6.41-1. Organize and conducts national competitions among residential facilities subordinated to the Ministry of Labour and Social Protection to select the best providers of residential care maintaining the highest standards of hygiene and safety, and professional performance;

6.42. Draft recommendations on the development organisations in republican ownership subordinated to the Ministry of Labour and Social Protection;

8. The Ministry of Labour and Social Protection shall:

8.1. Establish, reorganise, or close organisations in republican ownership subordinated to the Ministry of Labour and Social Protection; approve statutes of such organisations; issue permits to such organisations to engage in income-generating activities;

8.2. Perform calculation of the minimum subsistence level for specific socio-demographic groups, subject to subsequent approval by the Council of Ministers;

8.3. Register industry tariff agreements;

8.4. Delegate to subordinated organisations specific organisational, technical and informational support functions;

8.5. Submit to the Council of Ministers proposals to terminate or suspend regulations adopted by national government bodies on matters pertaining to the mandate of the Ministry of Labour and Social Protection;

8.6. Represent the Republic of Belaris in international and foreign organizations on active in the domains of labour, employment, social protection, and demographic security; conclude, within its mandate, agreements with the competent authorities of foreign countries;

8.11. Exercise other rights provided by the laws and regulations

9. Employees of the Ministry of Labour and Social Security shall have the authority to inspect, in official capacity, the relevant organisations; review matters within the mandate of the Ministry, request the appropriate documentation and demand official explanations.

The Ministry of Labour and Social Protection shall be headed by the Minister; the power to appoint and dismiss the Minister shall be vested in the President of Belarus.

The Minister of Labour and Social Protection shall have deputies; such deputies shall be appointed and dismissed by the Council of Ministers in consultation with the President of Belarus.

10. The Minister of Labour and Social Protection shall:

10.1. Perform day-to-day management of the Ministry of Labour and Social Security, bear personal responsibility for the delivery by the Ministry Ministry of Labour and Social Protection of its mandated functions, and the situation in the respective positive domain; make managerial decisions within the limits of his/her competence;

10.2. Assign functions and duties among the Deputy Ministers, defines the mandates of the heads of departments Labor and Social Security governmental entities subordinate to such Departments;

10.3. claims in the prescribed manner the structure and staffing of the central apparatus of the Ministry of Labour and Social Security within the established number and cost of maintaining the apparatus and services, according to the structure and coordinates the staffing of subordinate government agencies, coordinates the structure and staffing organizations in the system of the Ministry of Labour and Social Security;

10.4. approve statutes on structural subdivisions of the Ministry of Labour and Social Security, as well as statutes, subordinate government agencies, except for the provisions of the Fund, which is approved by the President of the Republic of Belarus, and the Department, which is approved by the Council of Ministers;

10.5. operates without a power of attorney on behalf of the Ministry of Labour and Social Security, represents its interests shall be disposed of in the prescribed manner of his funds and property, open bank accounts, grant power of attorney to represent the interests of employees of the Ministry of Labour and Social Security;

A collegium shall be established within the Ministry of Labour and Social Protection, comprised of the Minister of Labour and Social Protection (Chairperson), Deputy Ministers, and employees of the Ministry of Labour and Social Protection and its subordinated organisations, and a unions representative.

The number and composition of the Collegium shall be subject to approval by the Council of Ministers.

In the event of disagreement between the Minister and members of the board, the position of the Minister shall prevail; the Minister shall inform the Council of Ministers about his/her position; the members of the Collegium shall have the right to present their views to the Council of Ministers.

12. Funding for the central office of the Ministry of Labour and Social Security, organizations in republican ownership subordinated to the said Ministry shall be governed by the applicable laws and regulations.

13. The Ministry of Labour and Social Security shall have the status of legal person, and possess an official seal with the State Emblem of the Republic of Belarus and its name.
